Refunds & Returns

The terms and conditions of sale apply to the sale of all goods and services provided by Capitol Computer. Any variations or cancellations of these conditions shall not be binding unless agreed to by Capitol Computer in writing. Please ensure that care is taken when ordering as all goods sold are on a no refund basis. At our discretion we may consider requests to accept goods which have been ordered back for credit however, a restocking fee of 15% or $15 whichever is the greater will apply. In this case the goods must be returned within 7 days of invoice, and in new unopened condition.

Prices

All prices quoted are in Australian dollars and are inclusive of GST unless otherwise stated. Prices are subject to change without notice. We reserve the right to make adjustments to information or pricing due to typographical errors, market fluctuations, manufacturers price changes etc. that may occur at any time.

Warranty

Capitol Computer warrants that it will repair, or at its option replace, any of the goods which in its opinion are defective because of faulty materials or workmanship. Were the same item is unavailable we reserve the right to substitute with a similar item. Many items sold by Capitol Computer whether or not installed in a computer system such as sound cards, network adapters, speakers, printers, modems, scanners etc.are covered by a 12 month manufacturers warranty and as such are sold on a return to manufacturer basis only. Please refer to our support web page for details. No warranty claims will be accepted without proof of purchase. Warranty is not transferrable. In the event that goods are to be returned for warranty please contact our service department who will issue you with a Return Authorisation (RA) number. For this process we require invoice number, customer details and reason for return. No returns of any type will be accepted without an RA number. All Goods must be returned in their original packaging with all software and manuals included. Under no circumstances are we able to accept opened, non-faulty software for return. The benefits conferred by this warranty are in addition to the rights and remedies to which the purchaser is entitled in respect of the goods under the Trade Practices Act and any relevant fair trading act or other consumer laws except to the extent to which such rights and remedies apply and cannot be excluded, the above warranty supersedes and excludes all representations.

Delays

If Capitol Computer is prevented from delivering the goods because of any act of God, war, strike, lock-out, industrial dispute, government legislation or intervention, fire, flood, transport delays or any other cause beyond its control then it shall be entitled at its option to either extend the time for delivery until a reasonable period after such cause has ceased or to terminate the sale and in neither case shall the purchaser have any claim for loss or damage against Capitol Computer.

Freight

All freight charges are the responsibility of the customer. Capitol Computer will accept no responsibility whatsoever for goods lost or damaged in transit. If insurance is required we suggest you contact your insurance company to ensure your goods are adequately covered, or take up the optional insurance offered by Capitol Computer

Title To Goods

The goods shall remain the absolute property of Capitol Computer as legal and equitable owner and property in the goods shall not pass to the purchaser until the purchase price has been fully paid.
Until the purchase price has been fully paid:
1. The relationship between the purchaser and Capitol Computer is a fiduciary relationship and the purchaser shall hold the goods as bailee for Capitol Computer in such manner as to clearly identify them as being the property of Capitol Computer.

2. The purchaser may resell the goods in the usual course of its business but it shall keep separate records of sales of the goods and shall pay the proceeds of such sales into a separate account in trust for Capitol Computer.

3. The purchaser shall insure the goods and shall indemnify Capitol Computer against any loss or damage to the goods arising after delivery to the purchaser.

4. The purchaser shall notify Capitol Computer promptly of any levy of execution by the third party against the goods.
Default

Capitol Computer shall not be obliged to deliver the goods if the purchaser is insolvent or bankrupt or being a company that has been placed in the hands of a receiver or in liquidation.
a) If the total purchase price of the goods is not paid to Capitol Computer by the due date for payment or if any of the events referred to in paragraph (a) of this clause occur then, without prejudice to any other remedy to which it shall be entitled, Capitol Computer may take possession of the goods without any prior notice or demand and for that purpose the purchaser authorises Capitol Computer by its servants or agents to enter into any premises owned, leased or occupied by the purchaser and Capitol Computer shall be entitled to resell or otherwise dispose of the goods.

Governing Law

The sale of the goods shall be governed by the law in force from time to time in New South Wales and the purchaser shall submit to the jurisdiction of the courts of that State.
Errors and Omissions
Considerable care has been taken in the preparation of this price list to ensure that errors and omissions are limited. Even with the greatest care inaccuracies do occur and Capitol Computer are therefore not responsible for such errors or omissions. Photographs and graphics are used for representational purposes only and may not be the exact product or configuration as described.
